TERMS OF SERVICE

1. AGREEMENT TO THESE TERMS

These Terms of Service govern your use of ModdedEV.com and purchases from ModdedEv, operating as ModdedEV (“ModdedEV,” “we,” “us,” or “our”). By using the site or placing an order, you agree to these Terms and the Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, do not use the site.

2. INDEPENDENT AFTERMARKET BUSINESS

ModdedEv is an independent aftermarket accessories retailer. We are not affiliated with, endorsed by, or sponsored by Tesla, Inc., Rivian Automotive, Inc., Hyundai Motor Company, Ford Motor Company, Kia Corporation, or any other vehicle manufacturer. Manufacturer trademarks and model names identify compatibility only.

3. PRODUCTS, FITMENT, AND SITE INFORMATION

We work to keep descriptions, images, specifications, prices, compatibility, and availability accurate. Screen settings, lighting, production variation, and natural materials may cause minor appearance differences. Images may show vehicles or accessories for context that are not included unless stated.

You are responsible for confirming the vehicle year, model, trim, configuration, selected variation, and local legality before purchase. Contact us before ordering if fitment is uncertain. We may correct errors, update information, or cancel an affected order and refund the amount paid.

4. PRICES, PAYMENT, TAXES, AND ORDER ACCEPTANCE

Prices are displayed in the currency indicated on the site. Applicable shipping charges, discounts, duties when collected, and taxes are shown before payment. Accepted payment methods are those displayed at checkout and are processed securely by Shopify, PayPal, or another checkout provider. ModdedEV generally does not store full payment-card numbers.

An order confirmation acknowledges receipt but does not guarantee acceptance. We may decline or cancel an order for suspected fraud, payment failure, pricing or inventory error, shipping limitation, prohibited activity, or inability to fulfill. If we cancel after payment, we will refund the canceled amount to the original payment method.

5. SHIPPING, CANCELLATIONS, RETURNS, AND REFUNDS

Processing, production, delivery, tracking, address, customs, and split-shipment terms are in our Shipping Policy. Cancellation, final-sale, claim, return, replacement, and refund terms are in our Return and Refund Policy. Those policies form part of these Terms.

6. CUSTOM ORDERS

Custom requests may require design approval, additional charges, longer production, special materials, or minimum quantities. A quote or discussion is not an accepted order until specifications, price, and payment are confirmed. Customer-approved custom items are final as described in the Return and Refund Policy.

For a Custom Wheel Studio order, the configuration displayed at Final Review and recorded with the order is the customer-approved specification. Customers must verify the Tesla model and model year and review every material, color, component, retained factory function, and total price before purchase. Production typically takes up to one week and, for complex builds, may take up to two weeks in rare cases before shipment.

Unless expressly selected and included in the final configuration, factory airbag modules, steering-wheel buttons, electronics, trim, and other original components are not included and may need to be transferred from the original steering wheel by a qualified installer. A selected “retain” option indicates the custom wheel will be prepared to support that factory function; it does not replace a missing, incompatible, or defective original vehicle component.

7. INSTALLATION, SAFETY, AND LEGAL COMPLIANCE

Aftermarket products may require professional installation and can affect vehicle systems, sensors, warranties, roadworthiness, or regulatory compliance. Follow all instructions and use qualified help when appropriate. Do not install a product that appears damaged, defective, incompatible, or unsafe. You are responsible for confirming that purchase, installation, and use are lawful in your location.

Steering wheels, driver-airbag modules, controls, wiring, and heating components are safety-related parts. Custom steering-wheel installation, airbag or electronics transfer, and post-installation system checks must be completed by a qualified professional familiar with the applicable Tesla vehicle. Never probe, modify, energize, or install an airbag component contrary to manufacturer safety procedures.

8. ACCOUNTS, REVIEWS, AND ACCEPTABLE USE

You are responsible for safeguarding account credentials and providing accurate information. Reviews, photos, and other submissions must be truthful, based on genuine experience, and must not violate privacy, intellectual-property, or other rights. We may moderate unlawful, deceptive, abusive, or irrelevant content.

You may not misuse the site, interfere with security, scrape or copy content at scale, upload malicious code, commit fraud, impersonate another person, or use the store for unlawful activity.

9. INTELLECTUAL PROPERTY AND THIRD-PARTY SERVICES

ModdedEV site design, text, graphics, logos, photography, and original content are protected by applicable intellectual-property laws. Limited personal use does not transfer ownership. Third-party links, apps, carriers, and payment services have their own terms and practices; we are not responsible for services outside our control.

10. DISCLAIMERS AND LIMITATION OF LIABILITY

To the maximum extent permitted by law, the site and general informational content are provided “as is” and “as available.” We do not guarantee uninterrupted access or that every item will meet a purpose not expressly stated. Nothing here excludes warranties or consumer rights that cannot legally be excluded.

To the maximum extent permitted by law, ModdedEV will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from site use, installation, misuse, delay, or third-party services. Our aggregate liability for a claim relating to a product will not exceed the amount paid for that product, except where a greater remedy is required by law.

11. GOVERNING LAW, SEVERABILITY, AND CHANGES

These Terms are governed by California law and applicable federal law, without depriving consumers of non-waivable protections that apply where they live. If a provision is unenforceable, the remaining provisions remain in effect. We may update these Terms prospectively by posting a revised date on this page.
